Terms of Service — Atithi PMS

1. Acceptance of terms

By creating an account, registering a hotel, or otherwise accessing Atithi PMS ("the Service"), you agree to be bound by these Terms of Service. If you are agreeing on behalf of a hotel, resort, boutique property or multi-property group, you confirm you have the authority to bind that organization.

2. The Service

Atithi PMS is a cloud-native Property Management System providing reservations, front desk, billing and GST invoicing, guest management, housekeeping, POS, reporting and related modules, offered on Starter, Growth and Enterprise plans as described on our Pricing page. Features available to your account depend on your subscribed plan.

3. Accounts and registration

You must provide accurate hotel and owner details when registering, and keep your login credentials confidential.
You are responsible for all activity that occurs under your account and the staff accounts you create within it.
Every new hotel starts with a 14-day free trial; no credit card is required to begin the trial.

4. Subscription and billing

Paid plans are billed annually, per property, at the rate shown on the Pricing page at the time of purchase.
Room and property limits are enforced per plan (Starter: 1–10 rooms, 1–2 hotels; Growth: 1–25 rooms, up to 5 hotels). Exceeding your plan's limits may require an upgrade to continue adding rooms or properties.
Fees are non-refundable except where required by law, or as otherwise stated at the time of purchase.

5. Guest and hotel data

You (the hotel) remain the data controller for guest information you enter into the Service — names, contact details, ID documents, stay history and billing records. Atithi PMS processes this data solely to provide the Service to you, in line with our Privacy Policy. You are responsible for obtaining any consents required from your guests under applicable law.

6. Acceptable use

You agree not to misuse the Service, including attempting unauthorized access, interfering with its normal operation, or using it to store or transmit unlawful content. We may suspend accounts that violate this section.

7. Third-party integrations

Optional integrations (including WhatsApp guest notifications and Tally accounting sync) depend on the availability and terms of the respective third-party service, and may require additional configuration by you.

8. Termination

You may cancel your subscription at any time; access continues until the end of the current billing period. We may suspend or terminate accounts for material breach of these terms, including non-payment.

9. Limitation of liability

The Service is provided on an "as is" basis. To the maximum extent permitted by law, Atithi PMS is not liable for indirect, incidental or consequential damages arising from use of the Service.

10. Changes to these terms

We may update these terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised terms.

11. Governing law

These terms are governed by the laws of India, and any disputes are subject to the exclusive jurisdiction of the courts of India.
